A legal setback for governor andy beshear after a state court of appeals judge denied the governor's request to immediately stop two lower court rulings against his coronavirus emergency orders.

Abc 36's monica harkins is 'live' at the state capitol with more on what this means.

Today's ruling involves two separate cases...one out of scott county and the other out of boone.

In boone county a judge ruled against governor beshear's restrictions on class sizes at day cares and restricting crowd sizes at car racetracks.

And, in scott county a judge put a temporary restraining order against beshear's mass gathering regulations....speci fically in regards to agri-tourism.

The appeals judge says he's not expressing any opinion as to the merits of beshear's claims on the lower court rulings...adding...a three-judge appeals court panel will have to consider those.

The governor says he's ready to get the cases in front of the kentucky supreme court.

"beshear:i think we need legal certainty.

And i hope everybody out there says, sure, let's get it in front of the supreme court in a final ruling and not do this back and forth, or however many days ..., i'm not in this doing court cases i'm in this to save lives."

The kentucky court of appeals judge says beshear "failed to offer a reason why kentucky courts should not apply our laws and procedures in these troubled times."

So, we'll still have to wait and see what happens next.
